Pipeline? No!

Elected officials and candidates for public office are invited to a SpectraBusters panel discussion in Lowndes County, Georgia. Topics will include potential pipeline routes, property rights (eminent domain, property values), water issues (aquifer, sinkholes, springs), whether Florida even needs more power, better power sources (solar, wind, conservation, and efficiency), noise, health, and hazards. SpectraBusters and allies from all states are invited, and are encouraged to hold panels elsewhere.
Sabal Trail, Spectra, FPL, Williams, and Duke: we don’t come to your internal company meetings, and you’ll hear from us at the Scoping Meetings.

Why: Spectra Energy, which had compressor station leaks in Maine in January and in Pennsylvania last year, plus multiple fines by Pipeline Hazardous Materials Safety Administration (PHMSA) for corrosion and leaks, and a record $15 million EPA fine for PCB contamination, proposes a hundred-foot-wide gash through our lands for their huge 36 inch Sabal Trail gas pipeline from Alabama through Georgia to feed Florida Power and Light (FPL) and Duke Energy for no benefit to local citizens and rate hikes for FPL customers. A one-time payment is not enough for decreased property values, permanent destruction, and hazards of leaks and explosions, when FPL and Spectra and Duke would profit forever. The gas comes from fracking in Pennsylvania and Texas, destroying watersheds, farmlands, and drinking water. Conservation, efficiency, and solar power are cheaper and bring jobs and energy here where we need them.

AND NOTICE OF PUBLIC SCOPING MEETINGS

The staff of the Federal Energy Regulatory Commission (FERC or Commission) will prepare an environmental impact statement (EIS) that discusses the environmental impacts of the planned Southeast Market Pipelines (SMP) Project. The SMP Project is comprised of three separate, but connected, natural gas transmission pipeline projects: Sabal Trail Transmission, LLC’s (Sabal Trail’s) Sabal Trail Project in Alabama, Georgia, and Florida; Florida Southeast Connection, LLC’s (FSC’s) Florida Southeast Connection Project (FSC Project) in Florida; and Transcontinental Gas Pipe Line Company, LLC’s (Transco’s) Hillabee Expansion Project in Alabama. The environmental impacts of all three projects will be considered in one EIS, which will be used by the Commission in its decision-making process to determine whether the SMP Project is in the public convenience and necessity.

Even many FPL allies oppose new methane pipelines

FPL and Spectra could lose, because many organizations and individuals don’t want dirty methane pipelines when we can go straight to conservation, efficiency, and solar and wind power.

Kevin Spear wrote for the Orlando Sentinel 19 January 2014 Pipeline to bring natural gas to state,

Florida Power & Light Co. is on the cusp of getting the pipeline it has long wanted to carry natural gas from elsewhere in the nation to Central and South Florida to run the utility’s power plants.

But the proposed $3.6 billion project, which FPL hopes to start using in 2017, has drawn mixed responses from even groups that are usually allies.

Among them, Audubon Florida lauds natural gas as cleaner than coal when burned by power plants, while Sierra Club Florida opposes the line as likely to ensure that the state becomes further addicted to the fuel at the expense of developing solar power.

Other negative reactions include:

  • Contention by many environmentalists that the use of natural gas on the whole — from drilling to consuming — is as damaging to the environment as the use of coal.
  • Concerns that the route of the proposed pipeline is potentially harmful to Florida wetlands and aquifers.

Local governments can restrict pipelines –Penn. Supreme Court

Alabama, Georgia, and Florida probably don’t even have a restrictive law like the Pennsylvania Supreme Court just struck down, so local governments in the states along the proposed Sabal Trail, Florida Southeast Connection, and Transco Hillabee Expansion Project pipelines apparently can pass restrictions on pipelines. As can state legislatures.

The energy industry and policy makers in Pennsylvania, the heart of the nation’s gas drilling boom, are thinking about their next moves after the state’s highest court threw out significant portions of a law that limited the power of cities and counties to regulate the industry.

The state Supreme Court voted 4-2 on Thursday to strike down portions of a 2012 law that had been crafted by Gov. Tom Corbett and his industry-friendly allies in the Legislature.

Florida PSC tentatively approved pipeline

Where’s the Georgia Public Service Commission on a pipeline that gashes across Georgia to serve Florida? The Florida Public Service Commission has made an initial ruling.

Ivan Penn wrote for the Tampa Bay Times 24 October 2013, Florida PSC approves third major natural gas pipeline,

State regulators approved the construction of a third major natural gas pipeline Thursday that will increase Florida’s capacity by 20 percent at a cost of $3 billion.

The unanimous vote by the five-member state Public Service Commission clears the first of two major hurdles for the new system that is projected to come on line in 2017.

FL PSC determination about Sabal Trail pipeline not final yet

PAA Order PSC-13-0505-PAA-EI on FPL’s proposed Sabal Trail Transmission, LLC and Florida Southeast Connection pipelines; docket to be closed if order becomes final; protest due 11/18/13.

At the top of the document there’s this:

NOTICE is hereby given by the Florida Public Service Commission that the action discussed herein is preliminary in nature and will become final unless a person whose interests are substantially affected files a petition for a formal proceeding, pursuant to Rule 25-22.029, Florida Administrative Code.

And at the end of the document there’s this addendum,

NOTICE OF FURTHER PROCEEDINGS OR JUDICIAL REVIEW

The Florida Public Service Commission is required by Section 120.569(1), Florida Statutes, to notify parties of any administrative hearing that is available under Section 120.57, Florida Statutes, as well as the procedures and time limits that apply. This notice should not be construed to mean all requests for an administrative hearing will be granted or result in the relief sought.

Mediation may be available on a case-by-case basis. If mediation is conducted, it does not affect a substantially interested person’s right to a hearing.

On October 16, 2013, the Director of the Office of Energy Projects issued a letter in the above-captioned docket approving the request of Florida Southeast Connection, LLC (“FSC”) to commence the Federal Energy Regulatory Commission’s (“Commission”) Pre-filing Review Process of its proposed FSC Project (“Project”). Consistent with Sections 157.21(f)(1) and 157.21(f)(3) of the Commission’s regulations, FSC hereby submits, as an attachment, the letter sent to affected landowners establishing the dates and locations established for open houses.
