Albany, GA Resolution Against Sabal Trail Pipeline and Compressor 2014-10-28

The day after Dougherty County passed a resolution wanting Sabal Trail’s pipeline and compressor station out of the county and the state, its county seat Albany passed this resolution asking the same.

TRANSMISSION, LLC NATURAL GAS PIPELINE, AS
WELL AS THE ALBANY COMPRESSOR STATION
APPLICATION NO. 2236; REPEALING PRIOR
RESOLUTIONS IN CONFLICT AND FOR OTHER
PURPOSES.

WHEREAS, Spectra Energy, headquartered in the State of Texas, has proposed developing a 460 mile natural gas pipeline, a portion of which will traverse through Dougherty County, Georgia; and

WHEREAS, this project is typically referred to as SABAL TRAIL TRANSMISSION, LLC (hereinafter “Project”); and

WHEREAS, part of this Project is the installation of an extremely large compressor station, such that the citizens in Albany and Dougherty County will be adversely affected; and

Florida Gas Transmission intervenes in Sabal Trail CP15-17

How simple a motion to intevene can be: organization name, contacts, and Basis for Intervening. Filing to intervene gets your foot in the door for any further filings or legal actions or participation in hearings. It does not require filing major legal documents at the outset (or ever). It does require filing your motion to intervene by 24 December 2014. It would be prudent not to wait until the last day: you never know when FERC’s efiling system might be down.

This motion to intervene is by Sabal Trail’s competitor Florida Gas Transmission, which is, according to Kinder Morgan:

The Florida Gas Transmission (FGT) pipeline is an approximately 5,500-mile system that transports natural gas from south Texas to south Florida. FGT is owned by Florida Gas Transmission Company, LLC, a 100% owned subsidiary of Citrus Corp. Citrus Corp is a 50/50 joint venture between Kinder Morgan, Inc. (NYSE: KMI) and Energy Transfer.

FGT didn’t mention in this filing, but it knows sinkholes. Just a year ago FGT had to move its pipeline off of the famous 25-acre sinkhole in Assumption Parish, Louisiana.

Not one, but two resolutions proposed for next week against Sabal Trail

Tuesday, Lowndes County will finally vote on the resolution they already sent to FERC.

That same day, 9 December 2014, the Valdosta City Council will consider a resolution in support of Lowndes County’s opposition to the Sabal Trail pipeline, and quite likely the Valdosta City Council will vote on their resolution Thursday 11 December 2014.

This is excellent news to close the week in which Moultrie’s Mayor said on WCTV Moultrie, the county seat of Colquitt County, one of the two counties Sabal Trail said was one the two “as having the greatest potential to need additional gas supplies in the future”, that Moultrie wasn’t asked about Sabal Trail’s agreement with the Municipal Gas Authority of Georgia (MGAG). This week in which the Valdosta Daily Times quoted Spectra’s Andrea Grover backtracking on eminent domain.

A week now closed with two resolutions proposed for voting next week against Sabal Trail.

Email FERC Commissioners directly, and it still gets filed as an ecomment, as a Thomas County, Georgia resident demonstrated. And remember FERC could pick Alternative 3 which goes through Thomas County.

A Colquitt County resident spelled out a series of eminent domain threats to her, plus the background of the infamous Stewart County eminent domain ruling Sabal Trail has used to threaten landowners in other counties.

Federal Energy Regulatory Commissioners:

The article featuring an interview with Spectra’s Andrea Grover in today’s Valdosta Daily Times newspaper requires a response from an impacted landowner and please note that I am only one of possibly over a thousand in the same position. Ms. Grover asserts that allegations from homeowners that surveyors threatened eminent domain on their properties “hard to believe.”

Ms. Grover may be right that surveyors have not threatened eminent domain, but Spectra Energy and Sabal Trail land agents certainly have. In the second letter I received from this company dated September 16, 2013 (see attachments) requesting my signature for permission to survey my two tracts of land, the use of Georgia statute O.C.G.A. 22-3-88 was threatened.

MGAG didn’t contact local governments before agreeing with Sabal Trail

Looks like Spectra is still making stuff up. Apparently Spectra got one of its usual pipeline distributors to make a deal in Georgia for Sabal Trail without that distributor ever asking its own customers whether they needed the gas. This is very convenient for undercutting opposition to Sabal Trail’s threats of Georgia eminent domain, but not very useful to the named counties or to Sabal Trail’s own credibility.

Opposes Sabal Trail pipeline in any portion of Lowndes County –Lowndes County Commission

Escalating from the Chairman’s letter of 11 April 2014, perhaps after listening to requests from citizens, the Lowndes County Commission passed a resolution wanting no part of Sabal Trail in the county or in the state of Georgia.

Update 2014-11-25: Well, according to Joe Adgie in the Valdosta Daily Times today, “Even though the missive has already been mailed [to FERC], the resolution will not be formally voted on until the county commission’s next meeting in December [9th].”

Filed with FERC in docket CP15-17 on 21 November 2014 as Accession Number: 20141121-5242, but that was a Friday and FERC doesn’t work on weekends, so it actually appeared Monday 24 November 2014.
